KRC Garden operates as an online retail platform (“Service”) offering a curated selection of durable, eco-friendly gardening tools and accessories for sale. Our products include but are not limited to garden trowels, plant labels, watering cans, sprayers, and related items (“Products”), as described on our product pages.

  • Modify, suspend, or discontinue any aspect of the Site or Service at any time without notice.
  • Correct any errors, inaccuracies, or omissions on the Site and to change or update information at any time without prior notice.
  • Refuse or cancel any order at our discretion, including due to limitations on product availability, inaccuracies in product or pricing information, or suspected fraud.

  • ‌Account Creation:‌ To access certain features like “My account,” order history, or faster checkout, you may need to create an account. You must provide accurate, current, and complete information.
  • ‌Account Responsibility:‌ You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer/device. You agree to accept responsibility for all activities that occur under your account or password.
  • ‌Accuracy of Information:‌ You agree to provide current, complete, and accurate purchase and account information for all transactions made at our store. We are not responsible for errors you make in your order information.

  • ‌Product Descriptions:‌ We endeavor to display product colors, images, specifications, and descriptions as accurately as possible. However, we cannot guarantee that your screen’s display will be accurate. All Products are subject to availability.
  • ‌Pricing:‌ All prices are listed in the currency specified (e.g., Euro – €) and are subject to change without notice. The price charged for a Product will be the price in effect at the time the order is placed. Despite our best efforts, a small number of items may be mispriced. If an item’s correct price is higher than our stated price, we will cancel your order and notify you before charging you.
  • ‌Errors:‌ We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice.

‌5. Orders and Acceptance‌

  • ‌Order Placement:‌ When you “Add to cart” and proceed through “Checkout,” you are making an offer to purchase the Products in your cart. Your order is not accepted until we send you an order confirmation email. We may reject your order for any reason, including suspected fraud, inaccuracies in product or pricing information, or product unavailability.
  • ‌Order Confirmation:‌ The receipt of an email order confirmation confirms we have received your order but does not signify our acceptance of it. A contract between us is only formed when we send the shipping confirmation email. In that email, we will also provide an estimated delivery timeframe.
  • ‌International Orders:‌ Currently, we primarily serve Canada. For any future international orders, the customer is solely responsible for all import duties, taxes, and customs clearance requirements of the destination country.

‌6. Shipping Policy‌
All orders are shipped according to our separate Shipping Policy. By placing an order, you agree to the terms outlined therein, including:

  • Processing times of 2-3 business days.
  • Responsibility for providing an accurate shipping address.
  • Understanding that shipping costs are non-refundable unless the error is ours.
  • Responsibility for any customs duties or taxes on international shipments.

‌7. Returns, Refunds, and Exchanges‌
All sales are governed by our Refund and Returns Policy. Please review it carefully before making a purchase. Key points include:

  • We ‌do not offer “refund-only” (returnless refund) resolutions.‌ A physical return of the item in its original, unused condition is required for any refund, except in specific exceptions detailed in the policy.
  • You must initiate a return within 30 days of delivery.
  • Refunds are issued to the original payment method within 10 business days of receipt and approval of the returned item(s).
  • Items marked as final sale, clearance, or personalized are non-returnable.
  • You are responsible for return shipping costs unless the return is due to our error.

The “KRC Garden” name, logo, and all related graphics are our trademarks.

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts located in Halton Region, Ontario, Canada.

If any provision of these Terms is deemed unlawful, void, or unenforceable, such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
